By accessing and using Go Auto Pulse ("Service," "Platform," "we," "us," or "our"), operated by Westpoint Capital OÜ (Estonia), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms & Conditions ("Terms") govern your use of our marketing automation and communication platform. By using our Service, you agree to these Terms in full. If you disagree with any part of these Terms, you must not use our Service.

Go Auto Pulse provides an AI-powered marketing automation platform that enables users to create, manage, and send marketing campaigns across multiple channels. Our Service includes but is not limited to:

• SMS campaign creation and management
• Email campaign creation and management
• AI-powered message generation (SMS Copilot, Email Copilot, Inbox Copilot)
• Contact management and segmentation
• Automated workflow creation and management
• Analytics and reporting tools
• Twilio and SignalWire integration for SMS delivery
• Email delivery via ElasticEmail and Resend
• Third-party integrations (Shopify, HubSpot, Gmail, Outlook)
• URL shortening service
• Content calendar management
• Team member management and permissions
• Agency and workspace account features
• Admin panel for account management
• Support chat system
• File attachment capabilities
• Email tracking and analytics
• Shopify discount code generation

IMPORTANT: You bear full responsibility for all content and recipients of your marketing campaigns.

By using our Service, you acknowledge and agree that:

• Content Responsibility: You are solely responsible for all content, messages, and communications sent through our platform (SMS, email, or any other channel). We disclaim all responsibility for what gets written or sent out.
• Recipient Responsibility: You are solely responsible for who receives messages through our platform. We disclaim all responsibility for message recipients.
• Compliance: You must ensure all campaigns comply with applicable laws, including but not limited to TCPA, CAN-SPAM, GDPR, CCPA, and local regulations.
• Opt-out Management: You are solely responsible for managing opt-outs and removing recipients who request to be removed from your lists.
• Data Accuracy: You are responsible for the accuracy and legality of all contact information and data used in your campaigns.
• Integration Usage: You are responsible for proper use of third-party integrations and compliance with their terms of service.
• Team Member Actions: You are responsible for all actions taken by team members you invite to your account.

We disclaim every bit of responsibility for the content, recipients, and outcomes of your marketing campaigns. When you purchase or use our service, you bear full responsibility for what you write and to whom you send messages.

CRIMINAL ACTIVITY IS STRICTLY PROHIBITED

You may not use our Service for ANY criminal activity. This includes but is not limited to:

• Fraudulent activities or scams
• Harassment or stalking
• Phishing attempts
• Spam or unsolicited commercial messages
• Violation of any applicable laws or regulations
• Intellectual property rights violations
• Transmission of malware or harmful code
• Impersonation or misrepresentation
• Distribution of illegal content
• Violation of privacy rights
• Circumvention of security measures
• Abuse of API or system resources

If any criminal activity is detected, we have the right to report it to authorities and close your account access immediately without notice or refund.

5.1 Standard Accounts

Individual accounts with access to core platform features.

5.2 Agency Accounts

Advanced accounts with workspace management capabilities and white-label options.

5.3 Team Members

Users invited by account owners with customizable permissions and access levels.

5.4 Enterprise Accounts

Custom accounts with specialized features and dedicated support.

General Refund Policy: We do not offer refunds unless purchased through third-party platforms where Go Auto has a strict partnership that dictates refunds are allowed.

Third-Party Refunds:

• AppSumo Deals: Can be refunded as per AppSumo's terms and conditions
• ProductCanyon Deals: Can be refunded as per ProductCanyon's terms and conditions
• RocketHub Deals: Can be refunded as per RocketHub's terms and conditions

Direct Purchases: No refunds are provided for direct purchases through our platform. All sales are final.

Subscription Cancellation: You may cancel your subscription at any time, but no refunds will be provided for the current billing period.

Credits and Usage: Unused credits do not carry over between billing periods and are not refundable.

We reserve the right to discontinue subscriptions and access at any point in time without prior notice.

This includes but is not limited to:

• Immediate account suspension for violations
• Service discontinuation for any reason
• Platform maintenance or updates
• Business decisions affecting service availability
• Changes to features or integrations
• API rate limiting or access restrictions

We are not liable for any damages or losses resulting from service discontinuation or account suspension.

Your privacy is important to us. Our data collection and usage practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.

Data Security: While we implement reasonable security measures including encryption and access controls, we cannot guarantee the absolute security of your data. You are responsible for maintaining the security of your account credentials.

Data Retention: We may retain your data for as long as necessary to provide our services and comply with legal obligations.

Data Processing: By using our Service, you acknowledge that data may be processed in various jurisdictions and consent to such processing.

Our Rights: The Service and its original content, features, and functionality are owned by Go Auto and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Rights: You retain ownership of content you create using our Service, subject to our right to use such content to provide and improve our Service.

AI-Generated Content: Content generated using our AI features is subject to OpenAI's usage policies and may be used to improve our services.

License: We grant you a limited, non-exclusive, non-transferable license to use our Service for your business purposes.

Feedback: Any feedback or suggestions you provide may be used by us without compensation or attribution.

Our Service integrates with various third-party services. Your use of these integrations is subject to:

• The third-party service's terms and conditions
• Proper authorization and API usage
• Compliance with rate limits and usage restrictions
• Data sharing as necessary for integration functionality

We are not responsible for the actions or policies of third-party services, including but not limited to Twilio, SignalWire, Shopify, HubSpot, Gmail, Outlook, ElasticEmail, OpenAI, Stripe, and others.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GO AUTO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Our total liability to you for any claims arising from the use of our Service shall not exceed the amount you paid us in the 12 months preceding the claim.

We specifically disclaim liability for:

• Content created or sent by users
• Recipients of messages
• Compliance with laws and regulations
• Service interruptions or downtime
• Data loss or corruption
• Third-party service integrations
• Actions of team members
• AI-generated content accuracy
• Campaign performance or deliverability
• Integration failures or data synchronization issues

You agree to indemnify and hold harmless Go Auto, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your marketing campaigns and their content
• Any legal actions taken against you for your use of our Service
• Actions of your team members
• Your use of third-party integrations

We may terminate or suspend your account and access to our Service immediately, without prior notice, for any reason, including but not limited to:

• Violation of these Terms
• Criminal activity or illegal use
• Non-payment of fees
• Abuse of the Service
• Excessive API usage
• Violation of third-party terms
• At our sole discretion

Upon termination, your right to use the Service will cease immediately, and we may delete your account and data.

Informal Resolution: We encourage you to contact us first to resolve any disputes informally.

Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions.

Any disputes not subject to arbitration shall be resolved in the courts of Estonia.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms.

Entire Agreement: These Terms constitute the entire agreement between you and Go Auto.

Severability: If any provision is found unenforceable, the remaining provisions shall continue in effect.

No Waiver: Our failure to enforce any provision shall not constitute a waiver.

Assignment: You may not assign these Terms without our written consent.
